Filing a lawsuit is a civil action taken to the court of law which consists of a plaintiff that has received damages from the action of a defendant. Most lawsuits involve dispute resolution of private law issues between individuals, business entities, or non profit organizations. Studies show that there are over 15 million civil cases that go to court each year.

When someone is sued and taken to court it usually leads to a Tort lawsuits because of the injuries sustained as a result of negligence, defective products, medical malpractice, or unsafe products.

There are 4 major types of lawsuits such as Tort actions, Civil action, Child Custody actions, and private nuances.

Torts Actions can include such things as trespassing, assault, negligence, product liability, as well as infliction of emotional distress. So for legal reasons torts can be divided up into such areas as intentional torts, negligent torts and strict liability torts.

Civil Actions are usually filed in a judicial district court with the most common types of civil actions being personal injury lawsuits, family law proceedings, civil rights violations, as well as breach of contract cases. So private legal issues can be resolved between business or people in a civil action lawsuit.

Custody Actions fall under family law to define legal guardianship as a result of a marriage annulment. The court determines which parent gets physical custody of the children under the age of 18. The parent that shows financial security and stability for the childs environment. A lawsuit can be settled on support payments and visitation schedules.

Personal Nuances can include frivolous lawsuits where one party sues another party for which there are no legal grounds for the dispute. Even in such cases it must be determined if the lawsuit has legal merit. If there is no legal justification for bringing the suit to court or no possible law on which the suit could be based, then it would be considered frivolous. In most cases legal attorneys can find such laws to make the personal nuances has a plaintiff and a defendant worthy of litigation.

Most lawsuits are filed with the goal of monetary compensation, enforcement of a right or to prevent an action. A lawyer must investigate the complaint and make sure it is valid and the court clerk will draft up a summons then the defendant is made aware of the charges against them, then they are required to respond to the court.

These legal proceedings could take months and even years to come to a final conclusion, from the pleading to the pre-trial, then the trial and judgment as well as the appeal. If the judgment is for the plaintiff, then the defendant must comply under penalty of law with the judgment.
